JAILED LAWYER'S SPOUSE ARRESTED The Miami Herald, http://www.herald.com , July 3, Miami attorney Elizabeth Martinez-Genova has been arrested for drug possession. Former Assistant Public Defender Damon Amedeo, 30, now faces nine felony charges in a federal investigation begun after Douglas D. Rozelle III, 18, was found dead Jan. 6 in the lawyer's bedroom. He left the office in January 2001 and began working at the law practice of Rozelle's father, Douglas Rozelle Jr. REVIEW DEATH PENALTY The Miami Herald (editorial) July 3, 2002. Prompted by two executions scheduled for next week in Florida, the editorial urges a review of Florida's death penalty. The U.S. Supreme Court cleared the way legally for the state to resume executions by lifting the stay on the two executions. The editorial comments, "That, in turn, allowed Gov. Jeb Bush to make the decision to lift Florida's unofficial death-penalty moratorium, which had been in place since January. Too bad the state didn't utilize the time to undertake a comprehensive review of its seriously flawed death-penalty system. That's especially regrettable in light of two recent thoughtful Supreme Court decisions -- one banning executions of the mentally ill and the other requiring jury sanction of a death sentence. If the court can worry about the fairness of the death penalty, why not Florida?" TYPICAL FLORIDA LAWYER According to the Florida Bar, The typical Florida lawyer is male, 45 years old, with 16 years of experience. PARANOIA It's hardly a shock these days to learn that surfing the Internet isn't a private experience. Internet-service providers have the ability to keep track of the sites you visit and the software you download. This article looks at a new wave of ET (as in "ET phone home") spyware that uses your internet connection to deliver espionage briefings on you. WHERE DOES THE TERM "GUMSHOE" AS IT REFERS TO PRIVATE INVESTIGATORS ORIGINATE? Many years ago I did a little research on this and found that the term gumshoe started in the days when most private investigators walked the streets and interviewed people for information so much they always managed to get gum on their shoes because they were consistently walking in bad neighborhoods usually in downtown areas where there was no one that cleaned up the sidewalks. The term caught on in the 40's and 50's in police departments and Hollywood as a term for private investigator.

STANDARDS FOR IMPOSING SANCTIONS UPON LAWYERS The Board of Governors of The Florida Bar adopted an amended version of the ABA Standards for Imposing Lawyer Sanctions and thereby provided a format for Bar counsel, referees and the Supreme Court of Florida to consider each of these questions before recommending or imposing appropriate discipline: 1. Duties violated; 2. The lawyer's mental state; 3. The potential or actual injury caused by the lawyer's misconduct; 4. The existence of aggravating or mitigating circumstances.
